AN ACT

ESTABLISHING A NATIONAL HIGH SCHOOL IN THE MUNICIPALITY OF MALITBOG, PROVINCE OF SOUTHERN LEYTE, TO BE KNOWN AS THE MALITBOG NATIONAL HIGH SCHOOL, AND APPROPRIATING FUNDS THEREFOR

 

Be it enacted by the Senate and the House of Representatives in Congress assembled:

 

Section 1. There shall be established under the supervision of the Department of Education a National High School in Barangay Poblacion, Municipality of Malitbog, Province of Southern Leyte, to be known as the Malitbog National High School.

 

Section 2. The Secretary of the Department of Education is hereby directed to take such steps as may be necessary for the immediate implementation of this Act and shall issue such rules and regulations as may be necessary to carry out the purpose of this Act.

 

Section 3. The financial amount necessary to carry out the provisions of this Act is hereby authorized to be appropriated in the General Appropriations Act of the year following its enactment into law and thereafter.

 

Section 4. This Act takes effect upon its approval.

EXPLANATORY NOTE

 

Due to the escalating tuition fee imposed by private high schools in the Municipality of Malitbog’s Barangay Poblacion, many high school students were forced to enroll in public high schools situated in remote areas where they are required to travel long distances just to get there.

 

Inaccessibility to public secondary schools has not only been the obstacle that students, their parents and educators have to contend with.  They were also challenged with problems on inadequacy of school facilities and lack of teachers because of the overcrowding that student displacement have caused.  

 

It is the responsibility of the State to guarantee that basic education is provided to every Filipino.  It is therefore imperative that the State addresses this problem by establishing more public secondary school units in remote areas.  Establishing the Malitbog National High School in Barangay Poblacion, Municipality of Malitbog would greatly help many students in their quest to secure a brighter future for themselves and their families.

 

Immediate approval of this bill is earnestly requested.

EXPLANATORY NOTE

 

The 1987 Constitution states that the State shall give priority to provide basic education, which is a vital component in fostering growth and social progress among the youth.  It is the State’s responsibility to ensure the accessibility of quality education to every child in the country. 

 

The intention of this bill is to make the said Constitutional provision tangible through the establishment of a national high school in Barangay President Quezon in the Municipality of Liloan, Province of Southern Leyte.

 

Barangay President Quezon is strategically located at the center of Barangays Malansa, Bahay, Saub and Bitoon which are too far away from the nearest high schools located in Barangay Estela in Liloan and Barangay Pinut-an in San Ricardo. 

 

Traveling to these schools are also too difficult for students because of the absence of roads, the rugged terrain, and cruel shoreline especially during the onset of strong Northeast monsoon wind locally known as “Cabunghan”.

 

These are the reasons the establishment of the President Quezon National High School is imperative.  It would provide the youth with better opportunities to pursue their education which would eventually lead to better and more productive citizens, necessary to the development of the countryside.

 

Immediate approval of this measure is earnestly requested.

A RESOLUTION DIRECTING APPROPRIATE COMMITTEES OF THE HOUSE OF REPRESENTATIVES TO CONDUCT A THOROUGH INVESTIGATION, IN AID OF LEGISLATION, INTO THE ALLEGED CONSPIRACY BEHIND THE APPROVAL OF CLA AIR TRANSPORT CO., AS THE PHILIPPINE FLAG CARRIER AND FOR POSSIBLE VIOLATION OF PERTINENT LAWS INCLUDING THE ANTI-DUMMY LAW

 

WHEREAS, CLA AIR TRANSPORT CO., a Japanese-controlled, all-cargo airline, is alleged to have misrepresented its foreign ownership and is registered officially as a Philippine flag carrier under a temporary authority granted by President Gloria Macapagal Arroyo;
 

WHEREAS, media has reported that said Japanese-controlled, all-cargo airline “exists only on paper” and that it has “no planes, no pilots and crew and no operating records or history to speak of”;
 

WHEREAS, CLA Air Transport had previously declared under oath that 60 percent of its capital was owned by Filipino stockholders;

 

WHEREAS, allegedly the CLA is owned 51 percent by Filipinos and 49 percent by Japanese investors, in violation of the Constitutional provision, which specifically mandates a 60 percent ownership by Filipinos of any public utility;

 

WHEREAS, with the present composition of the CLA Board of Directors, the corporation is, in effect, owned and controlled by Japanese investors where the Filipinos are mere dummies of the Japanese owners;
 

WHEREAS, CLA Air Transport had been denied in 1999 of its application for an extension of its temporary operating certificate due to problems arising from its ownership composition;

 

WHEREAS, the Civil Aeronautics Board (CAB) headed by then Transportation Secretary Pantaleon Alvarez approved CLA’s temporary permit for the six month period from May 6 to Nov. 6, 2002 subject to full ratification by the CAB in its succeeding meeting;

 

WHEREAS, even without ratification, CAB Executive Director Manuel San Jose, forwarded the CLA Air Transport application for an extension to the Department of Foreign Affairs and subsequently to Malacañang for approval;

 

WHEREAS, President Gloria Macapagal Arroyo, unaware of the pre-conditions,  granted the six-month extension of the CLA Air Transport, giving the Japanese-controlled cargo airline a national flag carrier status;

 

WHEREAS, the transmission of said  unratified CAB resolution to Malacañang and its consequent approval by President Arroyo constitutes a well-planned and executed conspiracy to circumvent the Constitution and a sell-out of the national interest;

 

RESOLVED AS IT IS HEREBY RESOLVED, to direct appropriate committees of the House of Representatives to conduct a thorough investigation, in aid of legislation, into the alleged conspiracy behind the approval of CLA Air Transport Co., as the Philippine flag carrier and for possible violation of pertinent laws including the Anti-Dummy Law.

A RESOLUTION

DIRECTING THE COMMITTEES ON GOOD GOVERNMENT AND WAYS AND MEANS OF THE HOUSE OF REPRESENTATIVES TO CONDUCT AN INVESTIGATION, IN AID OF LEGISLATION, INTO THE ALLEGED CORRUPT PRACTICES AND DISMAL PERFORMANCE OF THE BUREAU OF INTERNAL REVENUE (BIR) RESULTING IN THE ENORMOUS SHORTFALL OF REVENUE COLLECTION BY THE BIR UNDER COMMISSIONER RENE BANEZ

 

 

WHEREAS, the mid-year total tax collection report of the BIR under Commissioner Rene Bañez showed shortfall of P33.4 billion, the biggest ever in the post-war years, the first double digit shortfall where the current collection is lower than the previous years’ collection for the same period;

 

WHEREAS, the huge tax collection shortfall is expected to result in serious damage to the government programs especially those designed for poverty alleviation, food security, peace and order and economic growth, thus aggravating an already weakened economy and further worsening the projected budget deficit from a projected target cap of P130 billion to anywhere from P160 to P 200 billion;

 

WHEREAS, the only possible source of funds to make up for the monumental failure of the BIR to meet its target revenue collection for the year is foreign and local borrowings, which will only further aggravate the national debt which is Php 195.5 billion as of June 2002;

 

WHEREAS, among the major reasons behind the unprecedented and lamentable shortfall in tax collections of the BIR are alleged multi-billion tax anomalies under the leadership of BIR Commissioner Rene Bañez for and in behalf of the Fort Bonifacio Development Corporation - Metro Pacific - PLDT- Smart Communications Group where he was previously connected as a senior executive officer and tax director prior to rejoining government as BIR Commissioner, and other companies whose operations benefited directly or indirectly from these questionable and anomalous actions and decisions;

 

WHEREAS, the extent and impact of the tax anomalies and scams at the BIR under Commissioner Rene Bañez, has seriously impaired and wrecked government finances as shown by the tax or revenue losses incurred because of the granting of special privileges and tax breaks like tax refunds, exemptions, devaluation of real estate property values, which are now being exploited as precedents by other groups of taxpayers and this could further reduce an already damaged and failed revenue collection program with a PHP 33-35 billion shortfall for the first half of the year alone;

 

WHEREAS, efforts to ferret out the truth behind the unprecedented revenue collection shortfall, the tax scams and anomalies at the BIR have been avoided by the BIR Commissioner Bañez who has time and again fed President Gloria Macapagal Arroyo lies and half-truths to cover up for his incompetence and dismal failures at the BIR;

 

WHEREAS, the House of Representatives from which the power to appropriate the national budget emanates, will soon be taking up the proposed national budget for the coming year;

 

WHEREAS, the lack of material information, the miserable performance and gross incompetence of the BIR under Commissioner Bañez and the tax scandals during his term, compels the House of Representatives to look into the malaise, lack of leadership and failures of the BIR at the time when the country needs to improved, invigorated, competent, honest and dedicated services at the premier revenue collection agency of the government;

 

NOW THEREFORE, BE IT RESOLVED by the House of Representatives to direct the Committees on Good Government and on Ways and Means of the House of Representatives to conduct an investigation, in aid of legislation, into the alleged corrupt practices and dismal performance of the Bureau of Internal Revenue (BIR) resulting in the massive shortfall of revenue collection by the BIR under Commissioner Rene Bañez.

ENDORSING THE CONFIRMATION OF THE APPOINTMENT

 OF HONORABLE HEHERSON T. ALVAREZ AS SECRETARY OF THE DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES

 

Whereas, Honorable Heherson T. Alvarez has been a formidable figure in both Houses of Congress when he served as Senator in the 7th to 9th Congresses and as Representative of the 4th District of Isabela in the 10th and 11th Congresses;

 

Whereas, Honorable Alvarez is a respected leader who helped formulate sound policies significant to the country’s economic growth and political maturity;

 

Whereas, Her Excellency President Gloria Macapagal-Arroyo has given her full confidence in the ability of Honorable Alvarez to make a difference in the conservation and development of our natural resources by appointing him as the Secretary of the Department of Environment and Natural Resources (DENR);

 

Whereas, he has distinguished himself as champion of environmental protection and conservation in his works with environmentalist groups and in his career as a legislator, being an important figure in the passage of vital environmental measures such as the Clean Air Act of 1999 and the Solid Waste Management Act 2001;

 

Whereas, in his stint as the Secretary of DENR, he has made essential decisions that earned for him the respect of various sectors of society;

 

Whereas, reputable environmentalist groups have signified strong support and have staunchly lobbied for his confirmation as Environment Secretary;

 

NOW THEREFORE, BE IT RESOLVED AS IT IS HEREBY RESOLVED, that the appointment of Honorable Heherson T. Alvarez be confirmed by the Commission on Appointments.
